Michael Miszczak, 54, of Acorn Street, Newton-le-Willows, jailed for 25 years with an extended three years on licence after being found guilty of child rape, indecent assault and child cruelty

A monster who raped two young girls was previously jailed over a £115,000 benefits scam. Michael Miszczak, 54, and Sandra Jones, 52, “brainwashed”, raped and beat their vulnerable victims during a campaign of “grotesque” abuse. 
Judge Denis Watson, QC, fought back tears as he described their sick crimes, which police said were among the most despicable they had ever seen.
On one occasion Jones – jailed for 14 years – punched one of the victims, as her ex-husband, caged for 25 years, brutally raped the girl.
Today, the ECHO can reveal, Miszczak once appeared on ITV’s Tonight With Trevor McDonald as part of a study into Britain’s “sicknote culture”.






The ex-miner claimed a work accident left him so badly injured he relied on a wheelchair, but was caught jet-skiing, running and riding a camel.
Footage, taken from surveillance and home videos gathered by investigators, led to him being jailed for 12 months in September 2004.
Clips revealed him jet skiing on holiday in Australia and lifting a scaffolding rig into a van.
Miszczak was paid £250,000 compensation from the National Coal Board after a mining accident at Parkside colliery, near St Helens, in 1989.
He received £115,000 in benefits between August 1993 and October 2003, after claiming he was severely disabled and needed constant care to help with hygiene and a wheelchair.
But investigators followed him after a tip-off and unearthed a damning collection of home movies, which revealed the extent of his lies.
He admitted eight charges of false accounting and 11 of obtaining property by deception – repaying £115,411 to the state after selling his house.
Earlier this month Miszczak was found guilty of 10 charges, including child rape, indecent assault and child cruelty, following a trial at Liverpool Crown Court.
Jones, of Promenade, Southport, was convicted of four charges including aiding and abetting rape, assault causing actual bodily harm and child cruelty.

BOW — Police arrested a registered sex offender, a convicted child rapist from Franklin, after they found him naked in a vehicle on River Road late Friday night.

Daniel W. Rabbitt Sr., 60, was charged with indecent exposure/gross lewdness, according to a news release.

Around 11:30 p.m. Friday, a patrol officer pulled up behind a vehicle parked in front of a local business that was closed, and saw a man who appeared to be shirtless in the front seat.

When the officer approached, he realized the man was naked and asked what he was doing. “He responded he was pleasuring himself,” the release said.

Rabbitt was arrested and released on $2,000 personal recognizance bail, with arraignment set for March 27 in 6th Circuit Court, Concord.

According to published reports, Rabbitt pleaded guilty in 1993 to three counts of aggravated felonious sexual assault, for raping a young girl at his former Exeter home.

At his sentencing, the judge told him, “What you have done makes my stomach turn.”

“Get out of my courtroom,” the judge said. “You disgust me.”

The Louisiana 1st Circuit Court of Appeal has upheld the conviction of a child rapist who was sentenced to life in prison last year.
Judges on Feb. 17 affirmed the conviction but amended three of the sentences for 49-year-old Terry Lyn Smith of Oakgrove, who was convicted by a jury in January 2016 for sexually abusing a relative for more than a decade.
Crimes against the girl were committed in several jurisdictions, including Houma.
State District Judge Randy Bethancourt sentenced Smith to life imprisonment with no parole.
Smith, a member of the anti-government Sovereign Citizens Movement, filed a legal brief appealing his sentence on Jan. 12.
Terrebonne Parish Assistant District Attorney Ellen Doskey, who handles appeals for the District Attorney's Office, said judges still imposed Smith's life sentence for aggravated rape but amended three sentences for aggravated incest to provide him with the possibility of parole.
According to the court's ruling, the restriction for parole is only appropriate for someone convicted for aggravated incest if the victim is under 13 years of age by a person 17 years or older.
Doskey said the victim in this case was over 13 when the first offense occurred in 2007.
"Therefore, under the law the sentence can't be imposed without the benefit of parole," Doskey said. "So Mr. Smith is going to be eligible for parole for those three sentences, but the court said since he also has a life sentence for the aggravated rape, it's not necessary to remand him for re-sentencing. We're satisfied with the decision and agree that the sentence needed to be amended to comply with the law."
Smith's attorney, Prentice White, of Baton Rouge, declined to comment.
A self-professed anti-government advocate, Smith was indicted in 2012 as principal to the attempted first-degree murder of St. John the Baptist sheriff's deputy Michael Boyington.
According to the Southern Poverty Law Center, membership of the Sovereign Citizens Movement has been growing since the late 2000s. It says Sovereign Citizens believe in picking and choosing which laws to obey and which to ignore and don't believe in paying taxes.
Boyington survived the shooting, but his two colleagues didn't.


MONTGOMERY, AL (WSFA) - A Deatsville man is facing multiple charges including traveling to meet a child for sex following an investigation by the Montgomery Police Department.
MPD Capt. Regina Duckett says, Keith Christopher Barnes, 38, is charged with two counts of rape second-degree, two counts of traveling to meet a child for an unlawful sex act, and sodomy second-degree.
Duckett says Barnes made contact with the victim, a female teenager, through social media and traveled to meet her on two separate occasions: Between January 23rd and January 30th and again between February 3rd and February 14th.  
Barnes was taken to the Montgomery County Detention Center under a combined $210,000 bond.
MPD previously arrested another man, Brandon Phaly, 23, in connection with this investigation.

Deatsville man charged with rape, traveling to meet a child for sex February 27th 2017 WSFA 12 News Staff

Alleged rapist David Kausky faced a judge for the first time on Monday.
Kausky was captured over the weekend, months after Steubenville police launched an investigation.
Prosecutor Steve Lamatrice says that Kausky is a flight risk, citing the 6 months he spent on the run.
Judge John Mascio set his bond at $5 million.
Investigators say the crime was committed in August at a home in Steubenville. He was captured recently at an RV lot in Marietta by the U.S. Marshals.
“It's hard. You have an 8-year-old girl. We have kids and these are never easy cases. You hate the facts and you hate to have to deal with it,” Steubenville Prosecutor Steve Lamatrice said. “A person like this has to be put away. So whatever it takes, for Jane Hanlin and the prosecutor's office, she's gonna do it. I think the public should have confidence in that."
Kausky is being held in the Jefferson County Jail.
In 2014, two years after a jury found Robert D. Thornton guilty of rape and sexual abuse of a 12-year-old girl, the Utah Court of Appeals reversed the convictions.
The appeals court ruled that the trial judge had not conducted a sufficient analysis before letting the jurors hear evidence that Thornton, now 42, had encouraged his victim's mother to engage in prostitution and provided drugs to her.
Last week, Thornton had another reversal of fortune: The Utah Supreme Court on Feb. 21 reinstated his convictions in a 5-0 decision. The court's opinion upheld 3rd District Judge Katie Bernards-Goodman's decision to admit the alleged prior bad acts at trial.
Thornton was arrested Dec. 31, 2010, on an outstanding warrant after police came to the mother's home to check on the 12-year-old's welfare. According to charging documents, the girl said Thornton, who rented a room in the home, had been forcing her to have sex with him.
Prosecutors said the girl had not said anything about the abuse until a few months after it started because she felt her mother was too addicted to drugs to care. When she finally revealed what was happening, her mother did not call police because she had an outstanding warrant but did tell a neighbor, who notified authorities, court documents say.
Thornton was tried three times in 3rd District Court and his defense was the girl fabricated her accusations against him.
At the first trial, the prosecution and defense agreed to exclude evidence that Thornton allegedly had encouraged the mother's involvement in prostitution so she could make money to pay for the crack cocaine he was providing her. A mistrial was declared when the mother volunteered information about Thornton's alleged role in her prostitution.
At the second trial, the parties again agreed to exclude the evidence, and that proceeding ended in a hung jury.
Prosecutors then decided they needed to introduce the drug and prostitution evidence at the third trial. They requested admission on the basis that the evidence would help the jury understand the circumstances that gave Thornton the opportunity to abuse the girl and discourage her from coming forward sooner.
Bernards-Goodman granted the request and Thornton was convicted in 2012 of three counts of rape of a child, three counts of sodomy on a child, three counts of aggravated sexual abuse of a child and one count of tampering with a witness. He was sentenced to serve up to life in prison.
In an appeal of all the convictions except the witness tampering count, Thornton's attorneys argued that Bernards-Goodman erred in admitting evidence of his alleged past misconduct.
A three-judge panel of the Court of Appeals unanimously reversed Thornton's convictions, holding that Bernards-Goodman failed to perform a "scrupulous examination" of the prior misconduct. The decision said the judge should have analyzed the two types of prior bad acts — drug dealing and prostitution — separately to determine what evidence to admit.
"In the context of a trial for aggravated sexual abuse of a child, the jury's reaction to evidence of drug dealing could be markedly different than its reaction to evidence of a defendant pressuring a drug-addicted woman into prostitution," the appeals court ruling said. "Evidence that Thornton introduced [the] mother to prostitution could also provide a jury with a greater temptation to draw an improper inference about Thornton's propensity to commit the charged sex crimes than exists with the evidence of him supplying [the] mother with drugs."
That ruling was based on earlier opinions by the Utah Supreme Court that used the phrase "scrupulous examination" to describe a judge's role in assessing whether character evidence can be admitted.
The prosecution appealed, and the Supreme Court justices concluded in last week's opinion that, on reflection, the scrupulous examination standard "is more confusing than helpful," adding that "we accordingly repudiate it."
In its opinion, the Supreme Court did not look at the process Bernards-Goodman used to reach her decision to admit the evidence at trial of prior bad acts but whether she abused her "broad discretion" to do so. And, the court said, she was well within her discretion.
Thornton, who began his sentence at the Utah State Prison on Nov. 14, 2012, remained behind bars during the appeals. His first parole hearing is set for November 2027.

Utah Supreme Court reinstates child rape convictions  

CANTON — A St. Lawrence County grand jury indicted a Massena man Tuesday on 53 counts connected to years of child rape and sexual abuse.
In the 28-page indictment, Stacey J. LaPorte Jr., 26, of 52 Maple St., Apt. 5, Massena, currently an inmate at Oneida County jail, is charged with three counts of predatory sexual assault against a child and one count of predatory sexual assault, both A-II felonies, 10 counts of first-degree rape, one count of second-degree rape, six counts of third-degree rape, seven counts of first-degree criminal sexual act, seven counts of third-degree criminal sexual act, three counts of first-degree sexual abuse, two counts of attempted first-degree criminal sexual act and five counts of misdemeanor endangering the welfare of a child.
The indictment charges that from on or about the summer 2007 to on or about March 6, LaPorte committed the crimes of rape and criminal sexual act with two females. According to the first 33 counts of the indictment, one of the females was victimized from the age of 8 until she was 16. The indictment charges that LaPorte began victimizing a second 15-year-old female during the winter of 2015-16 through last March 6.
Moreover, the indictment charges that on or about Valentine’s Day weekend 2016, LaPorte provided alcohol to a 15-year-old female and a 12-year-old male before making them engage in anal and vaginal sexual intercourse with him and engage in sexual contact with a second 15-year-old female, both by force.
Within the same indictment, LaPorte is charged — with a female described as a “Jane Doe” — with two counts of first-degree criminal sexual act, three counts of first-degree rape, one count of third-degree rape and two counts of first-degree sexual abuse.
It is charged that on or about Aug. 29, 2014, in the county, LaPorte and Jane Doe acted in concert with each other and each twice engaged in oral sex with a 15-year-old female by forcible compulsion. Also on three different occasions that day it is charged that the couple engaged in sexual intercourse with the same 15-year-old female by forcible compulsion. It is also charged that on or about March 6 in the county, LaPorte and Jane Doe engaged in oral sex with a 15-year-old female and then engaged in sexual contact with a different 15-year-old female, both by forcible compulsion.
Following the handing up of the indictment Tuesday, District Attorney Mary E. Rain said it was “the most egregious case in my 33-year career.
“It is alleged that Stacey LaPorte made a brother rape his sister and do other sexual acts to each other,” Ms. Rain said. “He is indicted for four separate victims and the thing that makes this egregious is a pedophile usually stays within an age range and particular gender. This defendant went across from infants to teenagers and males and females.”
Ms. Rain made reference to the federal case pending against LaPorte. On Oct. 28, LaPorte and Mackenzie Bailey, 20, Massena, were arraigned in Syracuse by U.S. Magistrate Judge David E. Peebles on an indictment alleging they conspired to, and engaged in, the sexual exploitation of minors.
Bailey and LaPorte are charged with conspiracy to sexually exploit a minor child born in 2014 and two counts of sexually exploiting that child on two specific dates in 2016. In addition, LaPorte is charged with a fourth count relating to his exploitation of two children, one born in 2003, the other in 1999, on a specific date in 2016.
Each of the charges filed by the U.S. Attorney’s Office against LaPorte and Bailey carries a mandatory minimum sentence of 15 years, a maximum sentence of 30 years in prison, a fine of up to $250,000, and a term of supervised release of at least five years and up to life, as well as registration as a sex offender.

Massena man indicted on 53 counts in connection to rape and predatory sexual assault of children W.T. ECKERT MARCH 1, 2017

She was just a little girl when the sexual assaults began, a teenager testified Monday in Northampton County Court. At the time, she believed she liked the man who, she said, would force her to perform acts she found so distasteful.
She was 5 or 6 years old at the outset of the abuse that spanned most of her childhood, the teen said tearfully on the witness stand as the child molestation trial of 57-year-old Phil Leone of Easton opened.
Any fond feelings she had for Leone, she said, were finally disabused by what was happening.
"Because I realized the things he had been doing to me were not OK," the teen said.




Authorities allege Leone sexually abused the girl in Bangor and Easton for years ending in 2011 when she was 11 or 12 years old. Assistant District Attorney Tatum Wilson says Leone exploited the vulnerabilities of a child, swearing her to secrecy and claiming they would both get in trouble if she told.
"He told her it every single time he touched her, engraving it into her," Wilson maintained to the jury during opening statements.
Leone is accused of escalating sex crimes that include aggravated indecent assault and involuntary deviate sexual intercourse. He also faces child pornography charges, after police said they recovered images of naked children after seizing his computers during the investigation.
Wilson said Leone downloaded those images in 2012 and 2013, after the girl was able to stand up to him and end the abuse. But Wilson charges that Leone photographed the girl naked, images that police never recovered.





To the jury, defense attorney Robert Eyer said the lack of those pictures "casts a long shadow" over the case and raises questions of whether his client is falsely accused.
"They did not exist," Eyer told the panel. "They do not exist, and you will not see those."
Eyer maintained the prosecution's own witnesses offer "conflicted" stories that fail to prove Leone is guilty.
In her testimony, the girl said that when she was about 10 years old, she began to resist Leone. He would berate her, she said, and "basically try to make me feel terrible about myself."
"He started getting very, very angry with me and tried to lower my self-esteem," she said.
The teen said she first disclosed the abuse to a friend in middle school whom she swore to secrecy. Eventually, she said, she confided to her mother, who took her to police the next day.
She went to her mother, the teen said, after watching a video on the internet about someone who had found the strength to tell her family she was gay. The teen said she felt inspired by the story to reveal her secret.
A city man will spend seven to nine years in prison following his conviction on child rape charges.
Osvaldo Leite, 44, pleaded guilty Monday to an indictment charging him with two counts of rape of a child, two counts of indecent assault and battery on a person under 14 and one count of assault with intent to rape a child.
Leite had been accused of raping his girlfriend's teenage daughter in October 2014 while the mother of the child was at work. According to the Bristol County District Attorney's office, the Leite told the victim not to tell anyone, but she revealed the assault to her mother five days later.
"The defendant took advantage of his relationship with the victim's mother and sexually abused an innocent 13 year old girl," District Attorney Thomas Quinn III said in a statement. "Her focus should have been trying to enjoy her adolescence and not being sexually assaulted by her mother's boyfriend. I want to thank her for her courage in being prepared to testify against the defendant. I hope she can move forward and lead a productive life."

The case against a man accused of the rape and murder of his lover's six-year-old son was postponed in the South Gauteng high court sitting in Palm Ridge Magistrate's Court on Tuesday.

Mowson Patala26‚ raped and throttled Nyasha Roy Chifambo on March 8 last year.
Patala‚ who looked after the child when his mother was at work‚ bathed him and placed him on the bed before he called an ambulance.
He then called his girlfriend of two years Brenda Mapunganyika who was at work saying the child was sick. They took the child to hospital in a taxi. The child died on arrival at the Tembisa hospital.
Mapunganyika said her child was in good health when she kissed him goodbye and left for work in the morning.
Dr Lilliana Lulli who examined the child at the hospital said there was extensive bruising on the child's buttocks. She said the skin on the anus was normally tight but in this case it was loose and had tears.
Forensic pathologist Dr Sajida Medar told the court that the child had excessive bruises on his body. She said the injuries on the boy's anus could have been caused by an erect penis.
The case was postponed to Wedneday.

Man accused of rape and murder of partner's child Pertunia Mafokwane | 2017-02-28

AN ARDROSSAN pensioner was today convicted of raping an 11-year-old girl and attempting to rape a 10-year-old girl 35 years ago.
Archibald Shaw, 81, committed the horrific sexual abuse which Judge Bill Dunlop described as “a despicable catalogue of depravity“ in Kilmarnock and Newton Stewart.
His victims, who are now in their 40's, went to the police after hearing on the radio in 2013 that Shaw had been convicted of stalking a 15-year-old girl and jailed for 21 months.
Judge Dunlop told Shaw: “You have been convicted of a series of offences which show a despicable catalogue of depravity.
“In view of your recent conviction it is clear you have for some time been a serious danger to children and remain so even at your stage of life.”

Shaw was placed on the sex offenders' register and will be sentenced in March.
Advocate depute Paul Brown, prosecuting, said: “The accused has previous convictions for sexual offences against children.”
The prosecutor told the court that Shaw's victims came forward after hearing on the radio that he had been found guilty of stalking a young girl and added: “It was that conviction in July 2015 that caused the complainers to come forward.”
Shaw, of Barrie Terrace, Ardrossan, was convicted at the High Court in Glasgow of eight charges of sexual abuse, including rape. The offences were committed between 1982 and 1990.
Much of the indecency took place in a caravan. Shaw would ply his young victims with alcohol and make them watch pornographic videos before abusing them.
He raped his 11-year-old victim again on various occasions when she was aged between 16 and 19.
Sick Shaw claimed that he had had consensual sex with the girl once she turned 16, but the jury did not believe him.
During a video taped police interview Shaw was asked if he had raped the 11-year-old girl and he replied: “No.”
He was then asked if he was sexually attracted to her and replied: “No.”

Shaw also denied to police that he had tried to rape his 10-year-old victim on various occasions.
He was then asked by a police officer: “Do you remember committing any sex acts on them?” and he replied: “No.”
In evidence his victims said he ruined their childhoods.
One of them said: “He said if we ever told what had happened to us we would be taken away from our families.”
Solicitor advocate John Kennan, defending, will give his plea in mitigation when the case calls later this month.
Shaw showed no emotion as he was led away to the cells.
