A 56-YEAR-OLD Zambian was sentenced to 15 years in jail for raping a minor, and three months for entering Namibia illegally.
Bwende Kaumba was sentenced in the Katima Mulilo Regional Court last week.He will serve both sentences consecutively.
On 23 March 2016 in the Mabanga area, Kaumba took his seven-year-old victim to the bush where he raped her.
Kaumba pleaded guilty to both charges and said that he knew what he had done was wrong.
George Matali the public prosecutor in the case noted that the fact that Kaumba was employed at the minors homestead was supposed to mean something to him.
“Accused had a moral and civic duty to protect the minor but instead he brought harm to her.” He further noted that women and children are vulnerable because men are unable to control their sexual desires.
Magistrate Bongani Ndlovu said Kaumba knew that he was committing an offence despite his illiteracy as stated in mitigation.
He also noted that although the accused pleaded guilty, the forensic evidence linking him to the crime lessens his guilty plea.
Ndlovu further noted that a child was sexually violated and she will carry the resultant scar for the rest of her life.
Therefore he finds the sentencing appropriate though he considered the fact that Kaumba had remained in custody for 13 months after his arrest.
In mitigation the court was told that Kaumba was a first-time offender, who was illiterate and remorseful. Kaumba was represented by Hope Ngara from the directorate of legal aid.
PUNE: A 35-year-old watchman was arrested from Pashan on Monday for sexually assaulting his 13-year-old daughter from his first wife on Sunday night when the victim's mother had gone out for some work.
As soon as the mother returned home, the girl narrated the entire incident to her. "When her mother decided to lodge the complaint, the suspect fled," said assistant inspector Pramod Kshirsagar of the Chatushrungi police.
Kshirsagar said the police swung into action after receiving the complaint and arrested the suspect before he could leave the city. "He has been charged under Section 376 (rape) of IPC and the relevant sections of the Protection of Children from Sexual Offences (POCSO) Act," he said.
