A Birmingham child rapist has failed to convince appeal judges to set him free after arguing jurors should not have been told about his criminal past.
Shaun Yates, 45, of Lea Hall Road, Stechford, was caged for eight years at Preston Crown Court on June 9 last year.
He was convicted of two counts of rape which had been committed in Darwen, Lancashire.
Yates was ordered to serve an extra five years on licence following his release after the judge condemned him as a dangerous offender.
But his lawyers argued at London’s Appeal Court that his convictions were ‘unsafe’ as they claimed jurors should not have been told details of his previous convictions.
These included indecent assaults on young males and females and breaches of a sexual offences prevention order.
Defence lawyers at his original trial argued that his criminal record was being used by prosecutors to ‘bolster a weak case’.
His previous crimes were not similar to the alleged rapes and Yates’s defence had been gravely prejudiced, it was claimed at the appeal court.
But the ‘very experienced’ trial judge allowed the previous convictions to go before the jury. They were relevant to a ‘propensity to commit offences against children’, he had said.
Judge Goldstone, sitting with Lord Justice Davis and Mr Justice Stuart-Smith, has now ruled today that the trial judge was right at the Appeal Court hearing.
Yates’s previous convictions were ‘plainly admissible’ as evidence, he concluded, rejecting the appeal.

After 10 months free on bail, a 41-year-old former karate instructor was sentenced to five years in prison for raping his 13-year-old female student in North Attleborough last year.
Cory J. Ruel was sentenced to five years in prison and 10 years probation by a judge in Fall River Superior Court on Monday, according to a report by the Sun Chronicle. Ruel admitted to the rape in March, reducing his original sentence from an aggravated rape to a statutory rape.
"I hope you people are happy now," Ruel's mother reportedly said to the parents of the victim as they walked out of the courtroom, the Sun Chronicle reported.
The now-convicted sex offender worked as a part-time karate instructor at a YMCA in Attleborough when he raped the girl over a period of eight months, both inside his home and at the YMCA. Ruel reportedly had no criminal record and was married with two children at the time of his arrest last July.

A FORMER Cardigan man has been given a 20-year prison sentence after being convicted of raping a girl under the age of 16.
After a five-day trial at Swansea Crown Court, 53-year-old Kevin John Turner, who now lives in Felindre, Swansea, was found guilty of eight counts of rape, three counts of sexual activity with a child, four counts of sexual assault and possession of indecent images of a child.
On Wednesday, 10 May, at Swansea Crown Court, Judge Geraint Walters sentenced Turner to 20 years jail and instructed him to serve a minimum of 13 years and six months. He will be required to register as a sex offender for life.
The offences took place when Turner was living near Cardigan.
Detective Inspector Richard Yelland said: “Dyfed-Powys Police welcomes the lengthy sentence handed down in this case.
“The harm caused to victims of sexual abuse lasts far beyond the incident.
The sentencing recognises the lifetime of psychological harm caused to Mr Turner’s victim.
“This was a lengthy and difficult investigation for detectives based in Ceredigion, but their determination ensured we provided the courts with a strong evidence package that allowed justice to be serviced on behalf of the victim.
“I hope this outcome will give anyone else who has, or is, suffering similar abuse to come forward and report it to police.

NORMAN — Jesus Salvador Barajas Araujo, 36, of Norman, was charged Friday with performing lewd acts with a child — his niece. 
The abuse is believed to have occurred in April. Araujo is being held on $30,000 bail and is set to appear May 23 for a preliminary conference. A preliminary hearing conference is a meeting between the defense and prosecution to discuss the case and a plea bargain could be proposed.
According to a Norman Police affidavit, the mother of the victim contacted police in May. She told officers that her 14-year-old daughter claimed Araujo, her uncle, had molested her.
The victim was forensically interviewed at the Mary Abbott Children’s House a few days after the allegations were made.
The girl told the interviewer Araujo had inappropriately touched her when she stayed the night at his house.
Oklahoma court records show Araujo has no previous criminal history.
According to a report from the Oklahoma Department of Human Services, the state saw 15,187 children cases of child abuse and neglect in Fiscal Year 2016, including 689 victims from Cleveland County. Neglect made up the majority of cases, with more than 86 percent. Sexual abuse was reported in 3 percent of cases. 
State statistics also show that 80 percent of perpetrators were family members.
The Centers for Disease Control reports there were 683,000 victims of child abuse reported to Child Protective Services in 2015.
According to the CDC, younger children are the most vulnerable when it comes to experiencing abuse, with about 24 percent of victims being a year old or younger.

One of the most severe cases of child abuse in 2017 has taken place in Marion, Indiana.  According to WANE, a 34-year-old man has impregnated his girlfriend’s 10-year-old child.
It all began after Nicholas Thrash, 34, began dating victim’s mother, 32, about two years ago. At some point during their relationship, Thrash began to molest his girlfriend’s young daughter. The 10-year-old child eventually became pregnant after enduring sexual abuse.
Once authorities discovered that the child was pregnant by Thrash, they arrested the child’s mother and charged her with two counts of felony neglect of a dependent on May 16. The woman also has a son. Once the mother was arrested, Thrash reportedly evaded the police for one day. He was eventually caught by police on the afternoon of May 17.
The case reveals why it’s important for adults to check for warning signs of sexual abuse in kids. According to Stop It Now, signs include a sudden change in eating habit; mood swings of rage, fear, insecurity; developing new or unusual fear of certain people or places; and exhibiting adult-like sexual behaviors, language and knowledge.
If a child shows any of those signs, it’s important to create a safety plan and contact authorities who can investigate if anything is occurring in the child’s home.
The victim’s mother remains in jail on a $100,000 bond. Thrash is being charged with 10 counts of child molestation and is currently being held on a $500,000 cash only bond.

BROWN COUNTY, Texas - A man from Blanket was sentenced to 35 years in prison after he took a plea deal for sexually assaulting a young child. 
Gary Neil Craft, 65, plead guilty on Monday to aggravated sexual assault of a child, according to the 35th Judicial District Court. 
Court documents revealed the incidents happened with a girl under the age of 14 beginning on Jan. 1, 2014.
Craft was originally indicted in August of last year for continuous sexual abuse of a young child, according to court records.

MESA COUNTY, Colo. (KJCT) -- A Grand Junction man faces multiple counts of sex assault on a child, according to the Mesa County Sheriff’s Office.

The sheriff’s office said Brian Corwin, 45, was arrested on charges stemming from incidents that occurred with a child between July 2012 and November 2014.
Deputies said Corwin faces five counts of sexual assault on a child as part of a pattern of abuse, five counts of sexual assault on a child by a person in a position of trust, and three counts for a violent crime sex offense, which is a sentence enhancer.
Corwin is currently in the Mesa County jail on a $25,000 cash bond. 

GJ man arrested for sexual assault on a child  

A former Sheridan man was sentenced in federal court for transporting a child in interstate commerce with the intent for the child to engage in criminal sexual activity, namely sexual abuse of a minor in the third degree.
Rodney Lee Zahn, 61, a registered violent offender, pleaded guilty to the charge on January 30, 2017.
Chief U.S. District Court Judge Dana Christensen sentenced Zahn to 120 months in prison. Following his release, Zahn will be placed on supervised release for 10 years. Zahn is also required to pay $773.04 in restitution to the victim and forfeit his Ford pickup truck and camper that was used to transport the minor victim out of Montana.
In an offer of proof filed by Assistant U.S. Attorney Cyndee Peterson, the government stated that in late July 2016, Zahn befriended a family in Sheridan. This included the family's 16-year-old daughter. Due to a diagnosed intellectual disability, the child cannot make sound judgments and is at risk of being manipulated by others.
On the night of August 1, 2016, Zahn met the child a few blocks from the family's residence. Zahn and the child left Sheridan that night in his truck pulling a camper trailer. After discovering she was gone the next morning, the child's family reported her missing. On August 4, 2016, law enforcement located Zahn and the child in Casper, Wyoming. Zahn was arrested and was interviewed. Zahn admitted that he and the child left Montana and drove through Idaho into Wyoming.

Zahn admitted that he sexually assaulted the child twice during the trip. Zahn also stated that he knew the child was 16.
